COMMERCIAL LITIGATION
Our firm was founded by trial attorneys, and we pride ourselves in the aggressive representation of our clients involved in litigation. We litigate cases in state and federal courts, and we are licensed to pursue appeals at all levels up to and including the United States Supreme Court. We also have substantial experience in handling arbitration cases through a variety of organizations such as the American Arbitration Association and JAMS, and we have mediated hundreds of cases to conclusion.
INSURANCE DEFENSE
We are frequently called upon to represent clients in insurance defense matters. This includes both first-party and third-party cases, as well as professional liability E&O claims, personal injury claims, products liability claims, medical malpractice and long-term care claims, maritime claims, property damage claims and other general insurance defense matters.
OIL AND GAS/ENERGY
We have substantial experience handling a large volume of oil and gas and energy-related matters. We represent producers, refiners, midstream companies, utilities and companies involved in generation and compression. We draft, review and negotiate a wide variety of contracts for our oil and gas clients. Our attorneys also represent clients with trading issues.
INSURANCE COVERAGE
We are called upon regularly by our insurance clients to provide coverage opinions relating to all aspects of insurance coverage as well as to act as coverage counsel.
LAND USE
We have considerable expertise in the area of land use, having represented developers, homeowners, homeowner’s associations, and condominium associations in a wide array of matters involving land use and regulation. Our experience extends to condemnation and adverse condemnation disputes. Our firm is considered the preeminent firm in the Houston area for land use litigation involving municipal regulations.
LABOR AND EMPLOYMENT LAW
Many of the firm's clients have utilized us to defend employment and discrimination cases. These include claims for age and racial discrimination, sexual harassment and ERISA claims, as well as the enforcement and termination of employment contracts. We represent our clients before state and federal courts as well as the Equal Employment Opportunity Commission.
CORPORATE TRANSACTIONS/MERGERS AND ACQUISITIONS
Our attorneys counsel our corporate clients on a broad range of topics, including contract negotiations, corporate structure, stockholder agreements, participation agreements, and employment issues. Our practice includes all aspects of corporate law, including mergers, acquisitions, divestitures and restructuring.
BANKRUPTCY/CREDITORS' RIGHTS
We practice bankruptcy and creditors' rights law in state and federal courts. We also represent creditors in bankruptcy proceedings under Chapters 7, 11 and 13. Additionally, our attorneys participate as counsel to both borrowers and lenders in out-of-court workouts. We also pursue monies owed by debtors at the state court level.
CLASS/MASS ACTION LITIGATION
Our experience includes representation in class and mass action litigation. We have handled the defense of class and mass actions, and have been called upon to consult with other firms facing issues such as class certification.
APPEALS
The lawyers at our firm handle appeals from courts of original and intermediate jurisdiction, as well as administrative agencies. Our experience and qualifications include appeals to the Texas Supreme Court and the United States Supreme Court.
COMMERCIAL AND RESIDENTIAL REAL ESTATE
Our attorneys represent a wide range of commercial and residential lenders and borrowers with real estate issues including loans, construction matters, due diligence, workouts and foreclosures. We frequently assist commercial and residential developers in borrowing, title issues, lot sales, platting and zoning issues. We have represented a county in ad-valorem tax cases, a municipality in real estate matters and various homeowners’ associations and property owners in the implementation, alteration and enforcement of deed restrictions. Additionally, our attorneys appear as expert witness in real estate matters. We also represent numerous commercial landlords and tenants with regard to issues concerning commercial leases.
COMMON CARRIER/TRANSPORTATION
We actively handle all aspects of common carrier and transportation litigation. Our work for our clients includes addressing issues relating to all aspects of intrastate and interstate claims, as well as international shipments and maritime claims.
FLOOR – PLANNING LITIGATION AND COMPLEX FINANCIAL ARRANGEMENTS
Our attorneys possess extensive experience with all aspects of "floor-plan" litigation for our financial services clients. This experience extends to negotiating and drafting work-out agreements.
ENVIRONMENTAL LITIGATION
The firm handles litigation of claims relating to toxic tort, RECRA and CERCLA actions, Superfund liability, hazardous release issues and environmental contamination. Our attorneys have developed a close working relationship with numerous hydro-geologists and other consultants and testifying experts who are nationally recognized in this field.
INSURANCE GUARANTY ASSOCIATION REPRESENTATION
The firm is also proud to have carved a niche in representing and defending the insurance guaranty associations (IGAs) of many states. The firm has represented no less than eight different IGAs in "mass" declaratory judgment actions. As a result, we understand the nuances of each state’s relevant statutes and the interrelationship between the funds. This area of practice has also permitted our firm to achieve a high level of expertise in issues concerning the jurisdiction of Texas courts over out-of-state defendants.
